Although kleptomania is not considered a full-fledged mental illness, it is a condition that significantly diminishes an individual's capacity to control their actions related to the offense committed. In accordance with Article 32/2 of the Turkish Penal Code (TCK), courts may reduce the sentence of the defendant or convert the imposed sentence into security measures specific to mentally ill individuals in such cases. Article 32/2 stipulates that individuals whose capacity to control their behavior is diminished shall receive twenty-five years of imprisonment instead of aggravated life imprisonment, and twenty years of imprisonment instead of life imprisonment. In other cases, the sentence may be reduced by no more than one-sixth. Furthermore, the imposed sentence, provided its duration remains the same, may be applied partially or entirely as a security measure specific to mentally ill individuals.
